At the time when, in order to maintain their monopolist profits on the EU market, multinational producers within the British Agrochemicals Association Ltd (BAA), now called Crop Protection Ass. (CPA), decide to  judicially reviewed the Ministry of Agriculture, Fisheries and Food 's interpretation of EC Council Directive 91/414 concerning the marketing of plant protection products,

-the UK is indeed the first member state to implement such legislation in the eighties and this had a direct influence on other member states

-and in particular on France.

-France, with 40% of the EU market has always been reluctant to conforming to the principle of free movement of goods until, that is, AUDACE put pressure to bear on the French administration through Daniel Roques' complaint A/97/4806  [France forced to adopt parallel import legislation].

On the 7th August the French Ministry of Agriculture and Fisheries published a statement in the Official Journal [Avis aux opérateurs effectuant des importations dites parallèles de produits phytopharmaceutiques].
