On June 10^th 2001, the National veterinary and sanitary investigation division informed the public prosecutor's office of Lorient that Spanish veterinary drugs were being imported and used unlawfully.

The veterinary and reactive drug industry association (SIMV) and the regional council of veterinary surgeons of Brittany, the national association of independent veterinary surgeons and the higher council of the association of veterinary surgeons had joined themselves as civil parties to the proceedings, as had the association UFC "Que Choisir" [= Consumers' Association].

In fact, 105 growers in the Morbihan, Finistere, Cotes d'Armor, Landes, Lot and Pyrenees Atlantiques areas who had bought drugs in the Basque area of Spain from the veterinary company ALBAITARITZA had to account for their acts in the course of investigative proceedings.

Intervening in their defence, the AUDACE association wrote to the examining magistrate, explaining the foundations of the law which applies to the imports which were regarded as illegal.  At the same time, AUDACE lodged a complaint against France before the European Commission, claiming that its national legislation on veterinary drugs did not comply with Community law.

Agreeing entirely with AUDACE's arguments, the examining magistrate of the Tribunal de Grande Instance [court of first instance, both civil and criminal] of LORIENT issued instructions not to prosecute on March 14^th, 2003.

On March 18^th-19^th and 20^th, 2003, the civil parties above appealed against that order to the examining division of the Court of Appeal of RENNES.

In its judgment of November 13^th, 2003, which rested once again on the framework of Community law and regulations as AUDACE had explained at the start, the Court upheld the order not to proceed and ordered that all the Spanish veterinary drugs seized be returned to their owners.

So, despite an unfair balance of forces, a handful of growers have prevailed against the industry organisations and veterinary associations, also supported by the French consumers' union, which, once again, shows it chose wrongly.

As for the complaint against France before the European Commission, AUDACE regrets to have to report that, having admitted the foundations, the authorities have been dragging their feet on a draft decree for over a year, and is bringing legal action before the Court of Justice in Luxembourg.

In the meantime … for want of adequate national legislation, the Court of Appeal in RENNES has reminded us that it cannot be classified as an offence of importing veterinary drugs without a licence if they come from another Member State of the EU, are similar to and have a common origin with duly licensed French drugs.

 

 

Le 10 juin 2001. la Brigade Nationale d'Enquêtes Vétérinaires et Sanitaires portait à la connaissance du Parquet de LORIENT des faits d'importation et d'administration illicites de médicaments vétérinaires espagnols.

Le syndicat de l'industrie des médicaments vétérinaires et réactifs (S.I.M.V) ainsi que le conseil régional de l'ordre des vétérinaires de Bretagne, le syndicat national des vétérinaires d'exercice libéral et le conseil supérieur de l'ordre des vétérinaires se constituaient partie civile, de même que l'association UFC "Que Choisir".

De fait, 105 éleveurs du Morbihan, du Finistère, des Côtes d'Armor, des Landes, du Lot et des Pyrénées Atlantiques qui avaient acheté des médicaments au Pays Basque Espagnol près du cabinet vétérinaire ALBAITARITZA ont dû répondre de leurs actes dans le cadre d'une procédure d'information.

Intervenant dans leur défense, l'association AUDACE. écrivait au juge d'instruction et exposait les fondements de droit applicables aux importations présumées illicites. Dans le même temps, AUDACE déposait une plainte contre la France devant la Commission européenne pour non conformité au droit communautaire de la réglementation nationale sur les médicaments vétérinaires.

En totale adéquation avec les arguments présentés par AUDACE le Juge d'instruction du Tribunal de Grande Instance de LORIENT rendait une ordonnance de non-lieu le 14 mars 2003.

Les 18 - 19 et 20 mars 2003, les parties civiles précitées formaient appel de cette ordonnance devant la Chambre de l'Instruction de la Cour d'appel de RENNES.

Ainsi, et malgré un inéquitable rapport de force, Une poignée d'éleveurs a obtenu gain de cause contre les organisations professionnelles de l'industrie et des vétérinaires appuyées, de surcroît, par l'UFC qui, une fois encore, n'a manifestement pas fait le bon choix.

Quand à la plainte contre la France devant la Commission européenne, AUDACE est au regret de devoir informer que l'administration. après en avoir admis le fondement, tergiverse sur un projet de décret depuis bientôt un an et s'engage ainsi sur la voie de la procédure communautaire devant la Cour de Justice de Luxembourg.

Pendant ce temps ... faute de l'existence d'une réglementation nationale en adéquation, la Cour d'appel de RENNES a rappelé qu'il restera impossible de caractériser une infraction pénale d'importation de médicaments vétérinaires sans autorisation dès lors qu'ils proviennent d'un autre Etat membre de l'UE, sont similaires et ont une origine commune avec les médicaments français dûment autorisés.
